Terms of Service

1. Agreement to Terms

By accessing or using the Hiwosy API and related services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

These Terms apply to all users, including free tier users, paid subscribers, and enterprise customers.

2. Description of Service

Hiwosy provides a semantic deduplication and text analysis API that helps identify duplicate content, detect toxicity, and cache similar queries. The Service includes:

• Semantic Deduplication API
• Toxicity Detection API
• API Caching Service
• Analytics Dashboard (paid plans)
• Marketplace Integrations (e.g., Freshworks)

3. Account Registration

3.1 Account Creation

To use our Service, you must create an account and obtain an API key. You agree to:

• Provide accurate and complete information
• Keep your account credentials secure
• Notify us immediately of any unauthorized access
• Accept responsibility for all activity under your account

3.2 API Key Security

Your API key is confidential. Do not share it, embed it in client-side code, or expose it publicly. You are responsible for all usage under your API key.

4. Acceptable Use

4.1 Permitted Uses

• Integrating our API into your applications
• Analyzing text for duplicate detection
• Using toxicity detection for content moderation
• Caching and optimizing query performance

4.2 Prohibited Uses

You may NOT:

• Use the Service for illegal purposes
• Attempt to reverse-engineer, decompile, or extract our algorithms
• Resell or redistribute the API without authorization
• Exceed rate limits or abuse the Service
• Use the Service to build a competing product
• Submit malicious content or attempt to exploit vulnerabilities
• Use automated systems to scrape or harvest data from our Service
• Violate any applicable laws or regulations

5. Pricing and Payment

5.1 Free Tier

The free tier includes 1,000 deduplication queries and 100 toxicity checks per month. Free tier usage is subject to rate limits and does not include premium features.

5.2 Paid Plans

5.3 Billing

• Paid plans are billed monthly in advance
• All fees are non-refundable except as required by law
• We reserve the right to change pricing with 30 days notice
• Failed payments may result in service suspension

5.4 Quota Exceeded

When you exceed your monthly quota, API requests will return a quota exceeded error. Service will resume on the 1st of the next month, or you can upgrade your plan at any time.

6. Intellectual Property

6.1 Our IP

The Hiwosy service, including its algorithms, code, design, and documentation, is protected by intellectual property laws. Our deduplication technology is covered by pending patent applications with the USPTO (Application Numbers: 63/911,048, 63/915,918, 63/921,878).

6.2 Your Content

You retain all rights to content you submit to our API. By using our Service, you grant us a limited license to process your content solely for providing the Service.

7. Data and Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your data.

8. Service Availability

8.1 Uptime

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We reserve the right to perform maintenance with reasonable notice.

8.2 Modifications

We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes.

You agree to indemnify and hold harmless Hiwosy and its owner from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

11.1 By You

You may terminate your account at any time by contacting us. Prepaid fees are non-refundable.

11.2 By Us

We may suspend or terminate your account for:

• Violation of these Terms
• Non-payment
• Suspicious or abusive activity
• Legal requirements

11.3 Effect of Termination

Upon termination, your API access will be revoked and your data will be deleted according to our retention policy.

12. Dispute Resolution

Any disputes arising from these Terms will be resolved through:

1. Good faith negotiation between parties
2. Mediation if negotiation fails
3. Binding arbitration as a final resort

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. For EU users, mandatory consumer protection laws of your country of residence apply.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or website notice at least 30 days before taking effect. Continued use after changes constitutes acceptance.

15. Miscellaneous

• Severability: If any provision is unenforceable, the rest remains in effect
• Waiver: Failure to enforce a right does not waive it
• Assignment: You may not assign these Terms without our consent
• Entire Agreement: These Terms constitute the complete agreement
